Bench Engage is committed to protecting your privacy and to being transparent about how we
handle personal information. This Privacy Policy explains what we collect, why we collect it, how
we use and share it, and the choices and rights available to you.

1. Introduction and scope

This Privacy Policy describes how AltCMO, LLC d/b/a Bench Engage (“Bench Engage,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards personal information when you visit benchengage.ai (the “Site”), engage with our marketing and communications, or use the Bench Engage Workplace Engagement Platform and related services (together, the “Services”).

By using the Site or the Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use the Site or the Services. This policy does not apply to third-party websites, products, or services that we do not own or control.

2. Who we are and our role

Bench Engage provides a workplace engagement and employee well-being platform to organizations (our “Customers”). Depending on the context, we act in one of two roles under data protection law:

As a controller. For personal information about visitors to our Site, prospective customers, marketing contacts, and the account administrators who set up and manage our Services, we decide how and why that information is processed. This Privacy Policy governs those activities.

As a processor or service provider. When we host and process information on behalf of a Customer, for example engagement responses, survey data, or profile information about that Customer’s workforce, the Customer is the controller of that information. Our handling of it is governed by our agreement with that Customer, and their own privacy notice applies. If you are an employee or member of one of our Customers and have
questions about how your data is used, please contact your organization directly.

3. Information we collect

We collect information in three ways: information you provide to us, information collected automatically, and information we receive from third parties.

Information you provide

  • Contact and account details: name, business email address, phone number, job title, company name, and login credentials when you request a demo, create an account, or contact us.
  • Communications: the content of messages, support requests, survey responses, and feedback you send to us.
  • Engagement and well-being content: responses, entries, and other content you submit within the Services (often on behalf of, or as a member of, a Customer organization).
  • Billing information: billing contact and transaction details. Card payments are processed by our payment processor; we do not store full payment card numbers on our systems.
  • Marketing preferences: your subscription choices and the topics you tell us you are interested in.

Information collected automatically

When you visit the Site or use the Services, we and our analytics and marketing providers automatically collect certain technical information, including:

  • Device and browser information such as device type, operating system, browser type, language, and screen settings.
  • Log and usage data such as pages viewed, links clicked, referring and exit pages, dates and times of access, and features used.
  • Approximate location derived from your IP address (for example, country or region).
  • Identifiers set through cookies and similar technologies, as described in Section 04.

Information from third parties

  • Analytics and marketing platforms that measure how our Site and campaigns perform.
  • Business partners, referrals, and publicly available professional sources that help us understand and reach potential customers.
  • Integrations you or your organization choose to connect to the Services.
4. Cookies and tracking technologies

We use cookies, pixels, tags, and similar technologies to operate the Site, remember your preferences,
understand how the Site is used, and support our marketing. Cookies are small text files stored on your device;
pixels are small pieces of code that record activity such as page views and email opens.

We group these technologies into the following categories:

  • Strictly necessary: required for the Site and Services to function, including security and load balancing. These cannot be switched off in our systems.
  • Analytics and performance: help us understand how visitors interact with the Site so we can improve it.
  • Marketing and functional: help us measure campaign performance, tailor communications, and recognize returning visitors.

ANALYTICS PROVIDER

Google Analytics

We use Google Analytics, a web analytics service provided by Google LLC, to understand how visitors find and use our Site. Google Analytics uses cookies and similar identifiers to collect information such as the pages you visit, how long you spend on them, the source that referred you, your approximate location, and your device and browser type. This information helps us produce aggregated reports about Site activity and improve our content.

Google processes this data on our behalf and may also use it in accordance with its own policies. You can learn more in Google’s Privacy Policy and in How Google uses information from sites that use its services.

Your choice: you can opt out of Google Analytics across all sites by installing the Google Analytics Opt-out Browser Add-on, or manage analytics cookies through our cookie controls where available.

MARKETING AND CRM PROVIDER

HubSpot

We use HubSpot, a customer relationship management and marketing platform provided by HubSpot, Inc. HubSpot places cookies and a tracking pixel that record activity such as the pages you view, forms you submit, and links you click, including links in our emails. When you submit a form or click a tracked
link, HubSpot may associate this activity with your contact record so that we can manage our relationship with you, respond to your requests, measure campaign performance, and send relevant communications where permitted.

Your choice: you can manage marketing cookies through our cookie controls where available, and you
can unsubscribe from marketing emails at any time using the link in each message.

Managing your preferences

Where required by law, we request your consent before setting non-essential cookies, and you can change your choices at any time through our cookie banner or preference center. You can also control cookies through your browser settings and delete cookies already stored. Some browsers offer a “Do Not Track” signal or a Global Privacy Control; where we are required to honor such signals, we will do so. Blocking some cookies may affect how the Site works.

6. How we use your information

We use personal information for the following purposes:

  • To provide, operate, maintain, and secure the Site and the Services.
  • To create and manage accounts and to authenticate users.
  • To respond to your inquiries, provide support, and communicate with you about your account or requests.
  • To process transactions and manage billing.
  • To understand how the Site and Services are used and to improve their performance, features, and content.
  • To send marketing and promotional communications where permitted, and to measure the effectiveness of our campaigns.
  • To personalize your experience and remember your preferences.
  • To detect, prevent, and address fraud, abuse, security incidents, and technical issues.
  • To comply with legal obligations and to establish, exercise, or defend legal claims.
7. Legal bases for processing

If you are located in the European Economic Area, the United Kingdom, or another region with similar laws, we rely on the following legal bases to process your personal information:

  • Consent: where you have given consent, for example to receive marketing communications or to set non-essential cookies. You may withdraw consent at any time.
  • Contract: where processing is necessary to provide the Services you or your organization have requested or to take steps at your request before entering into a contract.
  • Legitimate interests: where processing is necessary for our legitimate interests, such as operating and improving the Site, securing our systems, and marketing our Services, provided those interests are not overridden by your rights.
  • Legal obligation: where processing is necessary to comply with a legal or regulatory obligation.
8. How we share information

We do not sell your personal information for money. We share personal information only in the following circumstances:

  • Service providers and subprocessors: vendors who perform services on our behalf, such as cloud hosting, analytics (Google), customer relationship management and marketing (HubSpot), payment processing, email delivery, and customer support. They are permitted to use the information only to provide services to us.
  • Our Customers: where you interact with the Services as a member of a Customer organization, relevant information is made available to that organization as the controller of that data.
  • Legal and safety: when we believe disclosure is necessary to comply with a law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Bench Engage, our users, or others.
  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets, in which case information may be transferred as part of that transaction.
  • With your direction or consent: when you ask us to share your information or otherwise consent to sharing.

Some sharing with analytics and advertising partners through cookies may be considered a “sale” or “sharing” under certain U.S. state privacy laws. See Section 11 for how to exercise your choices, including the right to opt out.

9. Data retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, including to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete it or to anonymize it. Specific retention periods depend on the type of information and the context in which it was collected; we generally retain it for as long as your account or relationship with us remains active, and afterward for as long as needed to fulfill the purposes described above or to comply with our legal, tax, accounting, and dispute-resolution obligations. 10. Data security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, and alteration. These measures include encryption in transit, access controls, and monitoring. No method of transmission or storage is completely secure, however, so we cannot guarantee absolute security. Please protect your account by using a strong, unique password and by contacting us promptly if you suspect any unauthorized use.

11. International data transfers

We are based in Texas, United States, and we and our service providers may process personal information in countries other than the one in which you reside. These countries may have data protection laws that differ from those of your country. Where we transfer personal information across borders, we implement appropriate safeguards, such as Standard Contractual Clauses, to protect that information in accordance with applicable law. 12. Your privacy rights and choices

Depending on where you live, you may have some or all of the following rights over your personal information. We honor these rights in accordance with applicable law.

Access
Request a copy of the personal information we hold about you.
Correction
Ask us to correct inaccurate or incomplete information.
Deletion
Request that we delete your personal information, subject to legal exceptions.
Portability
Receive certain information in a portable, machine-readable format.
Restriction and objection
Ask us to restrict or object to certain processing, including direct marketing.
Withdraw consent
Withdraw any consent you previously gave, without affecting prior processing.
Opt out of sale or sharing
Opt out of the sale or sharing of your information and limit certain uses, where applicable.
Non-discrimination
Exercise your rights without receiving discriminatory treatment.
How to exercise your rights

To make a request, contact us at [email protected]. We may need to verify your identity before acting on your request, and you may use an authorized agent where the law permits. We will respond within the timeframe required by applicable law. If you are covered by the GDPR or UK GDPR, you also have the right to lodge a complaint with your local data protection authority.

If you are a member of a Customer organization and your request concerns data we process on that organization’s behalf, we will refer your request to that organization or assist them in responding.

13. Children’s privacy

The Site and Services are intended for businesses and individuals who are at least 16 years old. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

14. Third-party websites and services

The Site may contain links to third-party websites and services that we do not operate. This Privacy Policy does not apply to those third parties, and we are not responsible for their content or privacy practices. We encourage you to review the privacy policies of any third-party sites you visit.

15. Changes to this policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or legal requirements. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, provide additional notice. We encourage you to review this policy periodically.
